Does it matter whether the app was on?
It matters more than almost anything else. Coverage generally steps up as the driver goes from offline, to waiting for a request, to en route or carrying a passenger — with the largest limits applying during a trip. Establishing the app's status at the moment of the crash is often the whole case.
I was the passenger. Am I covered?
Passengers are usually in the strongest position, because the trip was underway and the highest coverage tier generally applies. You also have no comparative fault to argue about.
What if I was in the other car?
You can still claim against the rideshare policy if the rideshare driver was at fault and on a trip. The analysis is the same; you simply have to establish their app status, which your attorney can subpoena.
Can I get funded before liability is decided?
Sometimes, at a smaller amount. Funders price uncertainty. As liability and coverage firm up, a larger advance often becomes available on the same case.
